Cyber Defence Research Centre For Ranchi Stalled

Police in India is not very much comfortable with issues pertaining to cyber law and cyber security. Even if cyber crimes cells have been opened all over India they have not proved to be successful in the absence of adequate expertise.

India has also a very poor cyber crime conviction rate. The reason behind this is the police officers, lawyers and judges themselves are clueless about cyber crime.

Even if police force of India tries to make itself tech savvy, red tape and other governmental hurdles do not allow them to do so. For instance, the cyber defence research centre (CDRC), once proposed by the state of Jharkhand, seems to be the need of the hour with the government's official website being hacked twice in the past and recent successful cloning incidents of ATM cards at fuel pumps. In spite of alarms raised in the past by cyber experts in the capital and senior police officers, the proposal for CDRC constitution is yet to receive final nod of the government. The proposal for constitution of CDRC was sent to the state government for approval in March 2010.

The CDRC would constitute one chief technological officer (CTO) and two senior advisers from IT sector besides three cyber security professionals to be appointed from among civilians. The rest of the positions would be filled up by policemen trained in cyber security.

Special Branch IG S N Pradhan said once the CDRC was in place, Jharkhand would be one among the main centres of cyber security in India. Pradhan added that the centre would not only check cyber crime in state but also conduct high end research on cyber security and carry out cyber forensic tests to extend assistance to the security professionals at national level.

Computer Security In India

Online Arbitration In India

Online arbitration in India is at its infancy stage. Online arbitration is also known as cyber arbitration in India. Online arbitration in India is not very popular because there are very few online arbitration and mediation centre in India.

Online arbitration is an essential part of the online dispute resolution (ODR) mechanism. Online dispute resolution in India is still at its initial stages. It is facing many legal and technical roadblocks in India.

Indian arbitration law is incorporated in the arbitration and conciliation act, 1996. With the passage of time, it has become necessary to amend the same. Although much talk about amending the arbitration law of India has already taken place yet no constructive actions have taken so far.

Even the cyber law of India is defective. The information technology act, 2000 is the sole cyber law of India that requires urgent repeal. Further, the national litigation policy of India (NLPI) must also be reformulated as it is not catering the requirements of e-courts and ODR in India.

India Should Take Cyber Forensics Seriously

It is no secret that criminals are using information technology for various nefarious activities in India. It has become very important for law enforcement agencies, security agencies and legal and judicial members of India to understand technology.

Police force plays an important role in maintaining law and order in the society. Police force is also the first level of interaction that brings together cyber crimes, high tech crimes and terrorist activities and investigation techniques. Thus, police force must be well versed with and must have sufficient training for cyber law and cyber forensics issues.

When cyber criminals and terrorists are using technology, police force and security agencies of India cannot afford to be indifferent towards the same. India has limited cyber forensics laboratories and they are already overburdened. This results in a backlog of cyber forensics investigations and crucial evidence cannot be produced before the courts at appropriate time.

Cyber Security In India Is Needed To Defeat E-Surveillance

As more and more public services are attached to information and communication (ICT) technology, their security becomes of paramount importance. In India there is very little research, training and education in the field of cyber security. Further, even lesser is research and training regarding techno legal issues.

So much so that India has just a single techno legal cyber security research, training and education centre (CSRCI). The same is managed by Perry4Law Techno Legal Base (PTLB) and it is providing research, training, education, policy making etc in the crucial field of cyber security in India.

The truth is that authorities like unique identification authority of India (UIDAI) and projects like CCTNS, Natgrid, Aadhar, etc are violative of civil liberties and fundamental rights of Indians. The worst affected are the privacy rights in India that have simply been compromised for the façade of security. It is high time for Indians to reclaim their human rights before it is too late.

Homeland Security And Civil Liberties In India

Homeland security has assumed tremendous importance all over the world. Homeland security in India is also assuming importance and India is considering improving the same. However, homeland security is a highly specialised and collaborative model.

India has not yet actively considered homeland security. Even projects like CCTNS, Natgrid, modernisation of police force, e-surveillance and lawful interception, etc are poorly formulated and badly implemented.

International Commercial Arbitration In India

International commercial arbitration (ICA) in India has not taken the shape it deserves to be. As a result other countries have established themselves as the hub for ICA whereas India is still trying to reform it arbitration law.

The Arbitration and Conciliation Act 1996 governs the arbitration and mediation regime in India. It has become outdated and requires good amendments to attract ICA in India. At the same time the traditional litigation methods of dispute resolution are not very helpful for high staked commercial disputes. There is an urgent need to bring suitable legal and judicial reforms in India.

One factor that has resulted in inadequate ICA in India is India’s reluctance to use information and communication technology (ICT) for dispute resolution. This has resulted in a limited growth of Online Dispute Resolution (ODR) in India. ICA can be greatly benefited by the use of ODR in India.

Till now only private professionals are having necessary infrastructure and expertise regarding ODR services in India. For instance, techno-legal firm Perry4Law is the only institution that is providing techno-legal ODR services in India through its online dispute resolution centre of India. We need more initiatives on the lines suggested by Perry4Law.

According to Praveen Dalal, Managing Partner of Perry4Law the Law Ministry of India is in the process of revamping its alternative dispute resolution laws and it would be a good idea to make it a comprehensive and technology driven legislation.

Best Arbitration Institutions In India

Alternative dispute resolution (ADR) in India has been in use since many decades. The present law that governs ADR in India is the Arbitration and Conciliation Act, 1996. The Act provides for ADR remedies through arbitration and mediation. However, the Act suffers from many legal, procedural and structural defects and is in the process of being amended.

There are many good arbitration institutions in India that provide world class arbitration services. However, they are not following the contemporary international practices and norms. For example, there are hardly one or two arbitration institutions that are providing online dispute resolution (ODR) services in India.

In fact there is just a single techno legal ODR centre in India that is providing techno legal ODR services in India and worldwide. Further, there is a single online platform that provides techno legal research, training and education regarding ODR in India.

The national litigation policy of India (NLPI) declared by Law Minister Veerappa Moily is proactive and promising. It has advocated active use of ADR mechanisms like arbitration in India. However, even NLPI failed to consider the contemporary issues like ODR and e-courts.

India has a single ODR institution and single e-courts research, training and consultancy centre. This explains why e-court project of India failed and why till the month of August 2010 we are still waiting for the establishment for first e-court in India.

The problem lies with lack of political and judicial will in India as well as lack of expertise to use information technology for legal and judicial reforms in India. It would be a good idea if concepts like ODR and e-courts are essentially made part of NLPI and the proposed amended arbitration law of India.
